  • Illegal discharge of a weapon — State law prohibits anyone from “knowingly or recklessly” discharging a firearm into any dwelling or any other building or occupied structure or into any occupied motor vehicle.

In addition to defending clients facing state charges, our lawyers represent Coloradans in federal criminal cases.  Federal gun charges differ from state charges in notable ways.  They are, to begin with, prosecuted by federal authorities.  If someone is suspected of violating a federal weapons law, an officer from the Bureau of Alcohol, Tobacco, and Firearms (ATF) will conduct the arrest and the case will go to federal court, where there are strict sentencing guidelines that make plea bargaining tougher.

Moreover, federal firearms laws provide for particularly severe penalties.  The unlawful possession of a firearm by a convicted felon can result in 10 years behind bars.  If a firearm is used or carried during a drug trafficking crime or violent crime, the federal penalties are even harsher.  If a shotgun or assault weapon is used, an additional 10 years may be added to the penalty for the violent crime.
