  • A broader definition of "extraordinary and compelling reasons" to cover a wider range of medical conditions and exceptional circumstances
  • A streamlined process for requesting compassionate release, making it more accessible for inmates
  • Encouragement for courts to consider the potential impact of release on the inmate's family and community

These changes reflect a growing recognition of the need to balance justice with compassion, ensuring that inmates facing extraordinary circumstances have a fair opportunity to seek clemency. Several scenarios may warrant compassionate release, including:

  • Terminal illness — Inmates with a terminal prognosis and a life expectancy of less than six months may be considered for release.
  • Debilitating medical conditions — Inmates with severe medical conditions that render them incapable of self-care or require extensive medical attention may be eligible.
  • Exceptional family circumstances  Inmates with urgent family needs, such as the care of a terminally ill child or a spouse facing a life-threatening illness, could be eligible.
